I was not much struck with the evidence of bad conduct in Hartford City.”In conclusion the judge said: ‘‘The judgment of this court is that Dr. Clouser recover on his complaint and that the defendant, Rosa Clouser, take nothing by this suit.”And the great Clouser divorce suit was ended. While the decision was generally satisfactory it was a great surprise to those who supposed that Rusa would get a slice of the old man’s money anyway because she was a woman. The result is a great victory for J, A, Hindman, who won his case single-handed against two of the ablest attorneys of the Muncie bar.Rosa Clouser loses her divorce suit, her witnesses lose their fees and her attorneys lose much valuable time which, if they had won,- would have brought them fat fees indeed.Judge Vaughn, in deciding against Rosa, ordered that the costs be taxed against her. This is a technicality which deprives her witnesses of tlvb fees which they claimed with great punctuality, unless Rosa pays them herself, which sne is not able to do. Dr. Clouser, however, will be compelled to pay the costs of his own making* because of the defendant’s inability to do so. The law requires that court costs shall be paid by somebody, and in this case, the doctor having brought the suit, he will be held for the costs of his own making that the defendant can’t pay. The costs in the case will not fall short of $300, it is said. The doctor will have to pay $200 of these. The thirty or more witnesses whom Rosa brought here the doctor will not be required to pay because their costs were not of his own making.The judge also made a further allowance of $100 for Rosa's attorneys which the doctor will pay. Besides Gregory and Lotz, of Muncie, the firm of Pierce Bonham, of this town, were actively engaged in the defense. The four lawyers performed work that would have entitled them to from $100 to $200 each—probably much more—if they had won the case. The $100 allowance therefore seems somewhat meager. But as Rosa’s attorneys probably went into the fight for a contingent fee they have not much ground for complaint.What Mr. Hindman’s fee will be for saving the doctor’s thousands cannot be conjectured, but it will probably be a big one.
