| George Cummings stated today.!j.ii!Ii(Special to The Times.)CROW 7 POINT, SepR -2.—JackBurke, Cedar Rake saloonkeeper and defendant in three criminal cases, is a fugitive from justice. New warrants are out for his arrest on the original three charges, larceny, assault and battery with intent to commit a felony, and conspiracy to commit felony. He has forfeited a three thousand dollar bond, half of which was in cash, and his new bopd is fixed at $10,000.With a Porter county jury partially selected yesterday evening and Burke in the courtroom apparently willing to go to the finish in the cases, he failed to show up this morning. Special Judge Pattee gave him until 1 o’clock this afternoon, when Burke still failed to show up, Judge Pattee declared his bond forfeited, the motion having been submitted this morning by special prosecuto.’’ Otto Bruce and Deputy Prosecutor August j Bremer. Fifteen hundred dollars ot the ■ bond was in cash, which had been put up by Ed Moriarity. J. H. Kennedy. Burke’s brother-in-law, was on the bond with Sforiarity.It was rumored about the courthouse yesterday that Burke was ready to plead \ guilty and take a sentence to serve a ! year in a penal institution, but his proposition is said to have been rejected by the attorneys for the state who insisted j on the trial.Edward Lyons and George Davis Burke’s alleged confederates in the pickpocket arrest3 at the county fair this j afternoon, insisted on going on trial. Their attorneys, W. J. McAleer and C. B. Tlnkham, who also represented BurRe. withdrew from the case and Attorney Thad Fa*pcher, attorney for the poor, stepped in to defend them.Burke being a fugitive from justice is subject to extradition from any state, j attorneys agree.BURKE DEFAULTEDj
