Cross yesterday in a City Court trial which although .devoid of fireworks gained dramatic surprise from two startling moves by the defense attorneys—their refusal to cross examine Mrs, Newhall’s story and Uteir deliberate withholding of any «lefense testimony.Tactics of defense counsel, P. R. Bottenhemi and George P. Roesch were a complete reversal from those used during the first trial last June. Hie change proved its worth. In June the jury was out two hours be-y fore it was finally discharged as unable to agree.Yesterday the jury came ' back after five minutes of deliberation to kitst Mrs. Newhall’s hopes with the verdict: No cause ot action.That was the word of only five Jproxs—but accepted by prior agreement on the number, for upon exhausting the panel bringing in several men from the streets, after long searches by the City Marshal and police a .sixth juror acceptable to feetft sides could not be found.In June, Mrs. Cross, nee Frances C.
