Lack of Material WitnessesGiven as Reason for Motionsm * •to Dismiss Criminal Actions.sthwl£On motion of the prosecuting attorney, O. W. Witham. the criminal cases against William Hines and Peter Welsh were dismissed Tuesday in the district court for lack of evidence on the part of the state.Hines, ‘ a resident of the Salmoif, was originally convicted of a statutory offense, and was sentenced to the penitentiary for a term of from two to five years. He appealed and after he had served part of the term the supreme court granted a reversal and sent the case back. Some of the witnesses had gone and the supreme court had held that part of the other evidence could not be admitted.Welsh, George Wood and Archie Ca-pron of Buhl were arreste^i in Buhl on accusation of Walter L. Wheldon, temporary deputy sheriff. Welsh and Wood were bound over by Justice Chester G. A. Divelbiss of Buhl, although in the preliminary, the deputy admitted that he had used and given $way part of the evidence he took from Wood. Ca-pron was tried before a jury in the probate court and acquitted. Through a misunderstanding, Wheldon, who is away working, was subpoenaed for the wrong date for the Welsh case and did not appear.,So there was no evidence against Welsh. The Wood case was previously dismissed.
