fDnlly of Thursday.]Folice Cocbt.—Washington Johnsonbefore Justice Quarton to-day, on a charge of oommitting an assault and battery cn Mr. Harry Basse, last evening, about five o’clock, near the corner of Fourth and William streets. A number of witnesses were examined and it appeared from the evidence that a colored boy. named Thoti. Mayo, made an assault on Mr. Basse’s son, George, and kicked him pretty severely, it having been reported to Mayo that young Basse hid .threatened to shoot him. Goo. Basso reported to his father, who immediately proceeded in search of Mayo, found him at the locality named, caught hold of him and asked why he had beaten his son. It se*ms that Mayo attempted to release himself, or made some resistance, when Air. Basse struck him with a rock. Mayo retaliated by a blow with the same kind of a weapon, and while vthey were thus engaged, Wash. Johnson struck Basse two blows on the back of the head, going behind him for that purpose, and inflicted two outs, one an inch the other an inch and a half In length, reaching to the bone. The accused testified that the blows were made with astone, Mr. Basse said that a knife was used, while the other witnesses were ignorant on this point. Dr. Davis, who attended on the wounded man, testified that the wounds on the bock of the head were clean cuts evidently made with a knife, or other sharp weapon, and if a few inohes lower, from the apparent force of the blows might have resulted fatally. After remarks by City Attorney Dunnegan, a fine of 560was inilioted on’Johnson.
