The case of the State of Indiana vs. Perry Steven Miller may reach jury late this afternoon or early Monday morning following four days of testimony in Hamilton County Superior Court. Miller, 21, is facing trial for alleged rape of a 19-year-old Arcadia area girl, May 21. Ac cording to the victim, she stop ped along a country road on that day thinking a motorist was hav ing auto trouble. Offering assist ance and then realizing she did not know the man, she attempted to leave. The attack happened after the man forced his way into the car at gunpoint and forced her to a lonely spot west of Arcadia. She reported that he tied her to a tree and assaulted her. An early arrest of P.S. Mil ler resulted while Tipton and Hamilton County law officers were in the process of preparing a case against Miller. Two At lanta men instigated the early arrest when they tried to ab duct Miller at gunpoint from his home. They were also arrested and charged with interfering with a police officer. The men are on $500 bond. Witnesses Called C. Donald Dawson, Hamilton County prosecutor, presented several witnesses on behalf of the State and also 15 exhibits during Wednesday’s and Thurs day’s court sessions. Thus far the State’s case seem ingly has run smoothy with only One Arrest, One Released Charles E. Stewart, 38, 223 Fourth Street, was released from Tipton County jail Thursday at 7 p.m. on reconaisance bond. He will appear today in city court to hear charges of disorderly conduct and public intoxication. Other action taken by sheriff’s department is arrest of Stephen J. Ford, 25, Windfall at 11 a.m. Thursday. Ford was arrested on contempt of court charge and will appear in circuit court, one quirk in testimonies. A path ologists testimony was dis allowed by the court. Deemed by observers as not vital in the case, the jury was asked to dis regard the pathologist’s testi mony. A Tipton doctor was to appear as State witness Tues day but due to the continuance was unable to make appearance Wednesday. The pathologist was called to give testimony instead. Mark Nelson, Hamilton County deputy sheriff, was expected to be final state witness today at 9:30 a.m. Observers at the trial stated that the case looks favor able for the state.
