On March 14, 1891, cWilliam C. Clover made a will in his fc a, own handwriting, leaving all of his sr- property to the two brothers afore- s0- mentioned. After the making of the v ip will W. C. Clover A b- continued to live with his wife up to slt; r, the time of his death. !;d During the trial of the contest of c le the will in probate coirrt evidence ii in was adduced to show that W. C. ii at Clover made a new will in 1911, re-y voking the old will made in 1891. s- The copy of the new will, however, m could not be found, but a number of a witnesses averred on oath that they le had seen and read this new will, ly Search through the documents of de-*i- ceased found no trace of the will m which bad been made in 1911. r- Francisco Clover, brother of the j N ig deceased William C. Clover, filed forjprobate the old will made in 1891,; S ly and if same had been probated it le would have deprived the widow and re her living sons of any of the rights ly of William C. Clover, deceased. After le hearing the evidence adduced and ^1- arguments of law for more than aal week, the court was of the opinion j P ie that the proponent of the will, Fran- j y cisco Clover, had not proved to the j \satisfaction of the court that the will ^of 1891 had not been revoked by a subsequent will, and therefore would j.* not admit it to probate. This de-cision of the court was in favor of: T Mrs. W. C. Clover and her son, Patri-jL cio Clover.During the trial of the ease before 7 the probate court T. C. Mann repre- H sen ted the proponent, Francisco b Clover, while A. C. Hamilton and John A. Pope represented the widow S and son of the deceased W. C. Clover, j Proponent gave notice of appeal to P the district court and the case will' be taken up in that tribunal at its October term.
