Witness also stated that he met McGregor on the road one day carrying a shot gun and ax and he informed Siler that he had been over to shoot Nort Finch’s dog. Me gregor was in an angry mood.DEFENDANT TAKES STANDThe defendant, Jesse Crump was next called to the witness chair and after direct examination by his council, was subjected to a gruelling cross-examination by the attorneys for the state. Mr. Crump stated that he was born in Hancock county. He gave a detailed account of his life up to the time he moved on the Keny land in Bolivar township. The witness described the number of acres, location etc., of the Kelly, Finch and McGregor land in Bolivar. He stated that himself and McGregor were 011 the best of terms up to within a few clays of the tragedy and had often exchanged work. He gave a detailed account of allged trouble between deceased and Norton Finch over a fence during the month of April which ended in McGregor striking Finch with his fist. While putting in a post on a line fence, witness heard McGregor say that if Finch comes up, that he would “take spade and tear his head off.” A few weeks before the tragedy Crump served a notice, written by Dr. Kelly, on McGregor that his fence was out of line. After McGregor had read the notice he said “Whoever puts his hands on that fence to bother it, I’ll blow his head off. Witness answered by saying “Now Don, I don’t want any trouble over fence, if it is moved, Dr. Kelly will have to do it.” On Junejst 12th, the deceased and witness had another squabble. On this date early in the morning Crump went to the Voliva home to telephone for Dr. Lee to wait on his wife during childbirth. The doctor failed to arriveuntil after the child was born and later on in the morning Crump went a second time to the Voliva home to call the doctor and find out why he had failed to come. While he was waiting on the telephone call, Dr. Lee drove up to his home in an automobile. Witness stated that when he arrived at the gate in front of his home, McGregor was there and accused him of cutting his fence. The charge was denied and McGregor attacked him with a hoe calling him a g— d— liar. Crump stated that he dodged behind Dr. Lee’s auto. As McGregor was leaving he said ‘Tileet. von vet
