Mi!k CompanyUpheld in Suitt:r«By McKittrickCourt Holds They Violate No Law with Their Filled Milk SubstituteThe supreme court hold today the Carolenc Products Co. does not violate state laws against filled milk” and denied Attorney General Hoy McKit-trick’s plea to bar the company from business in Missouri.The case attracted wide interest among farm and dairy associations and grocery com-companies, The state department of agriculture, the Farm Bureau Federation and the Farmers Association supported the attorney genera!.'The Carolene company of Litchfield, 111., manufactures food products containing skimmed milk, cocoanut oil and vitamins A and D concentrates. The court described fill milk as a product in which a substitute has been used for nilk fat and milk.The court said the company’s products are wholesome, nutrit-ritious. uninjurious, unadulterated and beneficial,’' They are not sold “in imitation or semblance of milk.“We are unable to see how the buying public could be deceived into thinking that they were buy-mg milk when purchasing re-spondent’s products. We have reached the conclusion that respondent’s products sold in this state do not come within the prohibition of our filled milk statutes.
