M. E. Trapp of Oklahoma, according to advices received here today.Herwig, a former deputy sheriff in Osage county, Oklahoma, was convicted in February of this year on a charge of manslaughter growing out j of his shooting an oil field worker who was alleged by Herwig to have resisted arrest.j Following Herwig's conviction, he ap-i pealed the district court verdict to the 'Oklahoma criminal court of appeals and then filed an application for executive clemency. It was shortly after his conviction and perfection of an appeal bond (that he assumed his present duties as chief of police of Borger.Previous to his conviction Ilerwig had first been acquitted of the murder charge when given a preliminary hearing and j later when re-arrested and tried, a hung jury resuited.In his application for executive clemency, Ilerwig charged that he had been “persecuted’’ by the Ku Klux Klan, and Edward M. Box, executive clerk of Governor Trapp, before whom the pardon hearing was held, concurred in this view | in his report to the Oklahoma executive.The application for clemency was resisted by the Oklahoma attorney general's office which prosecuted Herwig, although John King, former assistant attorney general, who was prosecutor, recommended a full pardon. At the hearing George F.
