District court upholds verdictThe district Court of Appeals has upheld the 1973 conviction of Robert Dugan, Kenosha, on a burglary charge.During Dugan's jury trial, seven years ago, Judge Burton Scott limited the defense cross-examination of a prosecution witness about that witness’ juvenile court record At the time, Judge Scott cited the statutory ban on admission of juvenile records into evidence as the reason for limiting the cross-examinationDugan’s post-conviction motion claimed Scott’s limitation violated his right of confrontation because he could not establish the witness’ bias and motive to lie.The appeals court held that other, permitted cross-examination shows Dugan was able to sufficiently attack the witness' possible bias, and that the excluded inquiry would have been inconsequentialJudge Scott, now a member of the appeals court, did not participate in the appeals decision
