Preliminary examination into charges of uttering, forgery, and obtaining goods by false pretences, preferred against Filis Sharpe, of a Jones Pen address, which was be gun before His Honour Mr. C. M MacGregor in the Kingston Resi dent Magistrate's Court on Thurs day last when on the course of the inquiry the Magistrate ordered Jack Shim, shop-keeper and a wit ness for the Crown, to be arrested on a charge of recrowving ty connec tion with the matter o was heard afresh this Thursday as the accused Shim was placed alongside Sharpe in the dock. At the conclusion the Magistrate committed both accused to take their tral on the diaries at the Home Circuit Court on Janu ary 2 next. When the inquiry was called on, His Honour and Mr. Fo AL Pixiey, solicitor for the accused Sharpe, took the point as to whether the evidence should be continued or taken afresh since Shim had been brought into the case as an accused party. Observing that he had read a recent decision on a case of like nature, His Honour said that he had decided to take the evidence afresh. The charges against the accuser parties were in connection with three trerees of fish, valued at £ 33 the property of EE. Ehrenstein and Co, Ltd., of Morant Bay, and briefly, the case stated by the Crown was to the effect that on Monday September 30 the accused Sharpe sent an adrayman named Joseph Rowe to Grace Nemerx’s Wharf to take delivery of the fish Accused then sent one with a note to Shims shop in East Street where Shim's wife received them. Later that afternoon Mr. de G. DaCosta Shipping Agent for Ehrenstein and Co, sent to Grace's Wharf for the fish which was in storage there and was informed that three tierces had already been removed. The police was communicated with, and in quiries led to one of the tierces bei ng found at the accused Shim's shop. The other two were found at Witham and Henry Shim’s shops at Stipe Pen and Old Hope Roads, respectively, PROTESTS PROCEDURE. After the statutory caution was read out by the magistrate, the ac cused Sharpe reserved his defence, while Shim made the following statement. “I gave evidence on this case against Sharpe, after the Court had heard my evittence T was arrested by Your Honours order T respects fully protest against the proce dure of first requiring me to give eviderce and then put me on my trial, and also against Your Hono ours action of starting proceeds+ Ings agaimst me, and yourself acts indicating at the question of my being committed for trial T am not gundiv.” He was represented by Mr. M. Ashenheim, of the firm of Milhol land, Ashenheim and Stone. Mr. H. G. Keeling, Clerk of the Courts ex amined the witnesses on behalf of the Crown.
