FEHWICK FIHED. |Jury Returns Verdict at Late Hour Monday Night.* i ** 1 1On the anniversary of his seventy-seventh birthday Thomas Fenwiok, an i old and respected resident of Greenville : township,was Monday night foond guilty I by a jury in the oircnit court of a charge ' of assaulting James Hollowell, a neighbor, with a deadly weapon. The jury assessed a fine of S600, but imposed no , costB, amounting to several hundred dollars, nor imprisonment The finding of the jury was a surprise to Fenwick's attorneys, Stotsenburg Weathers, who thought they had proved a complete case of self defense and Attorney Weathers said after the verdict had been returned that a motion for a new trial would be made.It was thought the case would continue for several days when it was started laBt Saturday but Judge Utz was compelled to go to English Tuesday and in order to finish the case Monday court convened an hour earlier than usual in the morning and a night session wub held. Each side was given one hour for speeches and the case was given to the jury at 7 o’clook and the verdict was returned about 10 o’clock.The trouble between the men originated over the ubo by Hollowell of a roadway across Fenwick’s farm. One day he was notified not to use the road and the shooting occurred the next day when Hollowell again oame to the road- \ way. Fenwick claimed Hollowell was carrying a hoe and paid no attention to bis commands to halt. He said he thought he intended to injure him and he Beized a Bhotgun which was standing conveniently near and hastily fired one shot.Hollowell swore on the stand that he sustained 160 wounds in hia legs from the load of birdBhot and that only two or three of the leaden missiles had been removed.
