Shutt Retrial | Bid StudiedCINCINNATI (AP) — Judge William Morrissey is considering a motion for a new tVial for convicted murderess Barbara Shutt on grounds that a confession attributed to her should not have been introduced in the, trial.ii Bernard Gilday Jr., attorney for the 24 - year- old parttime school teacher under a life sentence at the Ohio Reformatory for Women, said Wednesday that Miss Shutt had not been advised of her rights to remain silent before she took a third lie detector test May 26.Miss Shutt was convictd Oct. 6 by a Hamilton County Common Pleas Court jury of first-degree murder in the death of her foster mother, Dr. Jane Shutt, 43, on May 25. The jury recommended mercy.Gilday said that she was advised of her rights about three hours after she became a suspect May 26.Miss Shutt later repudiatedthe confession and told during the trial of how she “concocted” it to protect her father, Charles,75.
