Judge appoints state’s psychiatrist to evaluate double murder suspectBy Jeff RaymondTimes Staff WriterAustin psychiatrist Richard Coonsmay examine Vincent Seard to determine whether he is competent to stand trial, 216th Judicial District Judge Stephen Abies ruled during a pretrialMonday.Abies previously had appointed Kerr-ville psychologist Caroline Williams to evaluate Seard Williams concludedthat Seard was incompetent to stand trial However, prosecutors filed a motion to have Coons also evaluate Seard Seard has been charged with the March 10 slayings of Comfort residents Patricia Kutzer and Terry Ingram Seard's attorney, Kurtis Rudkin of Boerne, argued that Texas law does not permit the state to have its own expert evaluate a defendant once a court-appointed expert has done so “Once that was done and the statutewas followed, that was it, Rudkin said when contacted Monday afternoon The defendant could ask for a subsequent chosen expert, but not the state.” Rudkin said Coon's appointment could be grounds for a future appeal “Later on, depending on the outcome of the case*, that might be something we could complain about,” he said During Monday's pretrial, RudkinSee SEARD, page 3A
