Wade conviction upheld by CourtAn Alabama appellate court has upheld the conviction of a Walker County man in connection with the robbery of a Cullman County businessman, the TIMES has learned.The Alabama Criminal Court of Appeals Tuesday upheld the conviction of Allen Gerald Moye, 45, Quinton Rt. 2, in the robbery of Holly Pond businessman Roy Shaw on February 16th.Defense attorneys for Moye filed an appeal of a jury verdict against the Walker County man following his trial in May. The appellate court turned down theappeal and affirmed Moye’s conviction and 30 year sentence stemming from the charges.Moye was one of two persons charged in the February 16th robbery, when $37,800 was taken from Shaw’s residence.Shaw identified Moye as one of the two robbers during the trial in May and the jury returned a guilty verdict, despite the other defendant’s, John Henry Wade, testimony that Moye was not involved in the incident.Wade confessed to taking partin the robbery and was given a 20-year sentence when he pled guilty in Cullman County Circuit Court in April.Shaw pointed out Moye in the courtroom as one of two gunmen entering their home and taking $37,800 in cash and other items. The restaurant owner said Wade, the chief spokesman, and Moye threatened to kill them.Wade, who pled guilty April 30th, testified Moye was not involved in the* incident and named two other subjects instead.The Oakman man, who had several armed robbery charges pending against him in othercounties, said a Decatur man by the name of Tommy NealMcClune did most of the talking during the robbery and was his partner.A man with a first name of Howard lt;Wade professed not to know his last name) took all the money from the heist. This alleged Howard subject was from Jefferson Coy, Wade testified.The robbers gained entrance to Shaw’s home by posing as police investigators.Shaw and his wife identified Wade and Moye as the two persons who robbed them from lineups within three weeks after the robbery.The jury returned the guiltyverdict against Moye, despite other defense witnesses who testified that Moye was at his Walker County residence on the dale of the robberv.
