Judge Kirby Draws Attention In Legal Battle This Week(Issues An Injunction Preventing Arrest of A. HueyIn Legal Mix-Ups:Judge H. F. Kirby figured thi., week one of the most complicated Vegal entanglements ever to take place in Texas. Several weeks ago Kirby issued a writ of habeas corpus to free Arthur Huey, former tax assessor of Hutcheonson County, who was serving a two to four year sentence in the State Pen for embez-lement. Huey was releasd from the prison by Warden W. W. Waid in accordance with Kirby’s writ. Saturday, following a hearing in tho Hutcheonson County District Court, Judge Douglas of that county issued a bench warrant for Huey’s arrest. To counteract the warrant, Kirby retaliated by is suing an injunction which enjoined all peace officers of the state from “arresting or molesting” Huey The two above mentioned writs placed officers of the state in an embarrassing position. Either they obey the warrant of the West Texas judge and arrest Huey or they must obey the order of Kirby’s court and net arrest him. In case of either action they would have been charged with contempt by the court whose order they disregard ed.Huey was in Groesbeck Saturday and left town after Judge Kirby had issued his injunction. He was last seen Monday night in Houston when he attempted to secure another injunction from a Houston judge.Regarding his action in the case Judge Kirby issued the following statement to the Journal this week:“Therefore any person who has been given a license to practice law has known that when a case has been appealed from a district ♦court to the Court of Criminal Appeals, that the court from which the case has been appealed has no further jurisdiction to entertain or hear any kind or character of proceedings unless the case was reversed or remanded, which has certainly not been the case in the Arthur Hiipv rauJudge H.
