Fergasoo wee arraigned at the bar of the eoart and ordered to refund the money be had received aa a jaror for time when he had not been in attendance.Bernard BUney and Wm. Tash, indicted for assault and battery on Joseph Weis-miller, at Franklin Park, were pat on trial. Woodbridge Strong, Theodore Strong and ex-Senator Vanderbilt for the defense.The history of the ca e is, that on the 10th of May last, Bianey and Ta*h met Weismilier and a man named Acker at Franklin Park;-and traded horse* with Weismiller, agreeing to give him $80 to boot. While pretending to write a receipt for the money, Tash and Bianey had Weiamiller’shorse changed to their own wagon, and when they came oat of Beekman’s hotel jumped into their wagon and attempted to drive off. VVeiamiller canght ^he horse by the head because Tash had grabbed the receipt and ran oat, refusing to pay the money. Weiemiller told them they coaid not go until they paid the money. Then T-tsh jumped oat of the wagon and knocked Weismilier down and jumped on his hesd and face with his hravy boot*,, at ths name time BJaaey came out ot the wagon and assisted in beating \Vri.«miller. who was helpless on the ground.
