They refused to hold Fischei guilty of attemtping to seriously wound and possibly kill his neighbor^ and former partner in the beet-growing business, Henry Beeck-man.Fischer, who has been a rancher here for several years, after leaving the employ of the best sugar company at Chino, was accused of taking a chunk of eu-* ! calyptus fire wood from Beeck-nian'a wood pile, and, after filling the holes as drilled in the wood with gunpowder, replaced the piece in his neighbor's woodpile. A hired man, E. Burrier, testified he noticed the peculiar chunk of wood as he was abouti to shove it inh) the stove forthe preparation of a meal.The defendant flatly denied theasserted death plot when called as the principal defense witness by Attroney Scherrer, who represented him.Beeckman, under questioning i by Deputy District Attorney French endeavored to link a quarrel between himself and Fischer with the alleged attempt upon his life. He said he and Fischer had been in partnership in the growing of sugar beetsIi and when at the end of the sea-IIson the books showed a loss,II Fischer allegedly accused him of misapropriating the money. Since that time, they had been bitter enemies, the complainng witness charged, and Fischer was said to have frequently gone about in the neighborhood armed.Witnesses called for the state were Beeckman, Burrier, Sheriff Sweeters, who arrested Fischer; j Deputy Sheriff Knowlton.
