Doug Hendry, called by prosecutors a certainty now that he has been indicted, won’t come until next week, a spokesman for Gov. Reubin Askew said today.Until and unless the governor suspends him, Hendry is still the sheriff, the spokesman said.THE COLLIER COUNTY Grand Jury, at the conclusion of its second meeting Thursday afternoon, issued an indictment accusing Hendry of the misdemeanor offense of culpable negligence for shooting his 18-year-old son, Mark Alan Hendry.The indictment contends that on July 29 Hendry did, through culpable negligence, or a reckless disregard for the safety of another, discharge a loaded firearm . . . a pistol, thereby inflicting personal injuries to one Mark Hendry ... to the evil example of all others in like cases offending and against the peace and dignity of the State of Florida.The indictment was signed by the foreman of the grand jury, Shirley A. Willis.Maximum sentence, if convicted, is one year in jail ora $1,000 fine.COURT CLERKS this morning were preparing a summons for deputies to serve on Hendry, who is undergoing care and treatment at a West Palm Beach facility for possible alcoholism.His arraignment — the date to plead innocent or guilty — is set for 9 a.m. Oct. 28 before County Court Judge Richard M. Stanley.No bond is required to be posted and no arrest required when a summons is issued. This is standard procedure in most misdemeanor cases.The indictment issued Thursday, as are all indictments, is only an accusation. Proof of guilt comes only when a jury finds a suspect guilty or when a suspect pleads guilty.THE GOVERNOR'S spokesman this morning said that special prosecutor Richard E. Gerstein was in contact with Askew’s legal advisers Thursday informing them of the indictment.Mr. Gerstein said he would be forwarding immediately a copy of the indictment along with his report right away, the spokesman said.He said Gerstein referred to this as his final report.
