Attorneys Sketch Contrasting Pictures of Capone in Final Pleas at income Tax Triali - -FEDERAL BUILDING; Chicago, Oct. 16.—(/P)—Al Capone, merciless gangster and underworld power, and Al Capone, spirit of * open handed generosity and friend who never failed, were the contrasting pictures etched in oratory by attorneys for government and defense in final pleas'at the gangster’s income tax trial today.■ And through it all, Capone in person, sat with sullen visage, his usual smile missing, moving* his slumped position only to hand notes or documents to his lawyers, and replying with noncommital grunts to reporters’ questions. Even his clothing was more somber, his suit a dark, grayish green, his tie quiet colored, his shoes a shade less yellow* •The case was completed today except for two hours remaining of the, government’s final plea, and Judge James H. Wilkerson’s instructions to the jury. Attorneys on both sides said the jury probably will begin deliberating the gangster’s fate by tomorrow noon.On the jurors’ minds the government has sought to impress with a mass of testimony the belief that Capone had a princely income, spent dollars by the thousand without care, and kept his pockets well stocked with $100 and $500 bills.The only spoken evidence by the defense, was the testimony of “bookies” Capone patronized that he lost $327,000 to them on horse racing bets.“Even a child could not help after hearing- our evidence but to believe that Capone had a fabulous income —and cheated his government out of its rightful income tax,” said Prosecutor Samuel Clawson.“The government has produced (Continued on Page Two) ’
