Delphos Man Names Officer In Lawsuit For False ArrestVAN YVERT - A part-time Spencer Township constable has been named defendant in a $25,000 false arrest lawsuit filed in the Van Wert County Common Pleas Court by a Delphos insurance representative.Filing the suit last week was Richard Saltz of Delphos as the result of a Jan. 1, 1971, arrest on a charge of driving while under the influence of alcohol.Although first convicted of the charge filed by Darrell Hurles of Spencerville in Lima Municipal Court, the guilty verdict was reversed by the 3rd District Court of Appeals and the charge finally was dismissed by the Municipal Court on Oct. 6, 1971, Waltz contends in his complaint.The insurance agent charges that Hurles, a Spencer Township, Allen County, constable who worked whenever he wished with no prescribed hours, followed him from Spencerville into Van Wert County early on i the morning of the arrest.Waltz contends he was arrested about five miles west of the Van Wert-Allen countv line andforcibly placed in the constable’s car, then taken from Van Wert County to the Allen County jail in Lima where he was held until 6 p.m. that day.In filing the suit, Waltz contends that the case damaged his employment as an insurancei agent.He also contends the action has impaired his credit, name and reputation and has caused mental anguish. He is seeking $110,000 in damages and $15,000 for punitive damages and expenses.
