MCARTYACQUIITEDIN MURDER CASEMorrilion, Oct. 15—Marion McCarty on trial here for the murder of Char-1 i«* McArthur at Menifee last June, was acquitted by the jury Thursday night. The jury reached a decision within four hours. About 75 witnesses were subponaed for the trial Thursday morning.According to McCarty and other witnesses, who were heard Thursday, the trouble which resulted in McArthur’s death began when McArthur, who was drunk, drew a revolver on McCarty and forced him to accompany him to a still about a quarter of a mile from the McCarty home. McCarty’s testimony was that he attempted to leave i McArthur at the still later, but that • McArthur followed him, cursing and threatening to kill him.Two negroes, who overheard the j threats, appeared and tried to per-I suade McArthur to put away his gun. | Then McCarty’s wife came to the scene and McArthur, witnesses said, begancursing her and threatened her life.McCarty took this opportunity to go into his home for a shotgun and appeared before McArthur with it a few minutes later. When McCarty came back to the place he had left Mrs. McCarty and McArthur, the latter was cursing and abusing her, he said. Mi Carty and other witnesses testified that as soon as McArthur saw him he told McCarty with an oath to stand back or he would kill him. Whereupon McCarty fired.i!t
