Miller Opens His DefenseProsecution Quizzes 15 Witnesses, Rests Cosei-The prosecution rested its case Thursday in the district court jury ! trial of J. W. Miller, charged with ;e j murder in the highway death of j. I Donald Eugene Pybas of Trousdale, after about 15 witnesses were interrogated. Court recessed at 5:32 p.m., reconvening Friday morning. i- | With the opening of court Friday, the defense began examining witnesses.Among the defense’s witnesses Friday morning were Mr. and Mrs.Leo McNinch, brother-in-law andm sister of the suspect, by whom Miller was employed just prior to theaccident. McNinch testified thatMiller last worked for him on Sat-e : urday before the mishap on Tuesday, August 30. and that Miller P was doing farm work.'I Both Mr. and Mrs. McNinch said Miller has been highly nervous since his release from the U.S. Airni-r.iI.enr.eForce. He enlisted in the U.S. Navy J when only 17. and completed an ° enlistment in the U S Air Force, it was brought out.The defense is attempting to es-a tablish that Pybas, rider of a motorcycle. swerved out in front of ( Miller. The two-vehicle mishap oc-' ; curred August 30 about a half mile n north of the city limits of Ada, or directly in front of Kirk’s cafe. h j Miller was traveling toward downtown Ada in an automobile, and Pybas, who, it was established had been to the Car Hop Drive-in, also was headed toward downtown Ada. at about 10 p.m.Pybas was killed instantly in thecollision.City and county police investi-s gated the incident; H.
