The first degree murder charge carries the condition that the murder was premcdiatated and done with malice.Judge Robert Kinsey adjourned the trial at noon Friday, saying the jury would be better able to make a determination Monday than on Friday afternoon.The defense called five witnesses Friday morning. Joseph Schmid, 517 Somerset Drive, verified the testimony of his brother, Kermit, in describing a fight which occurred between Howard and Hart about two weeks before the shooting.Joseph Schmid said on the day of the skirmish, he and Howard were leaving Howard’s house when they noticed an occupied car parked in front.Schmid and Howard drove to Schmid’s house and the ear followed.At the Schmid house, Paul Hart and his wife, Patricia, got out of the car and a fight started. Schmid said he believed Hart started the tussle and that Mrs. Ilart also beat on Howard. He said the Harts were pressuring Howard for alimony or support payments for Mrs. Hart, who is Howard’s ex-wife. They were divorced a few months prior to the shooting.In an apparent attempt to discredit one of the prosecution witnesses, Charies Scruggs, defense attorney, called Howard’s parents.
