Some time ago we gave the details of the Elder’s troubles with a couple of the deacons of the Second Color* ed Baptist church, the deacons being arraigned before Mayor Hart, and adjudged guilty of disorderly conduct, in burling Mukes out of a church meeting, and fined to the full extent of the law. We felt in* clined to take the side of the Eider on that occasion, as it appeared that he was the innocent sufferer at the hands of a party of men, who had no more right in the church than he, but we fear the Elder is a barnacle on the church politic, at least the following new jierelopements of the case were made in atrial before Justice Jocelyn yesterday afternoon:Deacon Jesse Johnson, otherwise known Gooseberry, preferred a charge of assault and battery against Mukes, said assault being made with a cane on the night he was put out of church by Deacons Johnson and Miller. On the trial, the evidence showed that there was a regular church meeting on the evening in question, and that a vote of the members present being taken, Elder Mukes, who was not recognized as a member in good standing, was requested to leave. This he was not inclined to do, and oae of the deacons went to him and requested him to go, but he would not move. The oderator then ordered Deacons Johnson and Miller to lead him oat, which they proceeded to do, taking Makes each by an arm. When the party reached the door the Elder jerked away from them and hit Johnson with his cane. The Elder was finally overcome, and was ejected from the door of the sanctuary.The above is tbe gist of the evidence in the case, tbe Juitice holding that the church had a right to order any one, not a member, out of a church meeting, and if he did not go peaceably the church had the power to use force, the same as a private individualSjseiupthatofmolMfciiwutlpn•4diic0
