Coffinberry has been indicted on seven counts of burglary and larceny. Hearing is set Nov. 4 on his motion to quash four counts of the indictment on the grounds that they specify he is a habitual criminal.The indictment states Coffin berry was sentenced Feb. 20, 1945 to Missouri Penitentiary, and Dec 4, 1945, to federal penitentiary Counsel for the defendant main tains that there is no allegation that he served both sentences and therefore is ‘not a two-time loser under the state habitual criminalj/it
