Miss Clarke was the only witness sworn, and after her testimony was completed, Justice Greaney communicated with District Attorney Wilson in this city and the two agreed that the girl** story did not warrant holding the defendant lor the action of Uhs grand j jury.The alleged offense was said to have been committed bj Berea la a j woods alongside the Erie tracks in | the town of New Windsor on April J 11. Testifying last night the little girl j raid that about one o'clock, on the afternoon of April 1 she met Berea while she was walking along the; hichwaj. She said that with a pair of’pliers he cut the wire fence along; the road so that she and the defendant couid pass through into the : woods. Then she alleges he assaulted 4 her twice.■i -
