Jcnkinea, attorney for Saxon, stated the iines on which the defense wilt be made, Mr. Jenkines said that the evidence would show that the prosecuting witness registered at the Johnston hotel on the ~ morning of July 9th and was assigned to room No. 25. That she was at the hotel from the 9th till the following Sunday morning, the 22th, and at numerous times that she ordered intoxicating liquors sent to her room. On the Sunday morning on which the trouble occurred, she left the hotel and met Saxon. They drank together atScbubauh/s saloon, Jerry Sullivan’s place, Borgman'a on Twelfth street, and HUan's saloon near the Eighteenth street bridge. After which they walked across the river to the spot where the assault ia alleged to have occurred,WJ H, Moore, bartender at the Johnston hotel, Mrs. Kate Setm-baeh, Bridget Welch, Kate Sales and Kate Meyne, testified on oath that the couple drank together at Schu-bacha.Jerry Sullivan and Javid Hallam testified that the couple drank in * their saloons on Sunday morning.The defense will attempt to show that if any crime was committed it was with the consent of Mias Plausse “ and the alleged assault was a drunken quarrel. The defense will also attempt to ahow that Miss Plaoase was attempting to work a confidence game on the people under the garb 1 of charity. The defendant will take the stand as the final witness.
