Doug Hendry this morning pleaded guilty to a charge of burglary.Circuit Judge Charles T. Carlton postponed sentencing Mark Alan Hendry of Coconut Creek Drive until a pre-sentence investigation is complete. The judge allowed him to remain free without bond.He faces up to five years in prison.HENDRY WAS arrested July 29 shortly after what Naples police said was the burglary of the Chicken House Restaurantat 590 Tamiami Trail N. A 16-year-old companion was also arrested.The juvenile has given statements to prosecutors to use against the younger Hendry.Hendry was in court a month ago for arraignment, but it was postponed because he didn’t have an attorney. At the time. Acting Circuit Judge Richard M. Stanley refused to appoint the public defender to represent him.IN COURT TODAY, Hendry still didn't have an attorney.Carlton asked if he wished an attorney. Hendry said he didn’t. The judge advised him that the U.S Constitution andstate laws provide that he can have one. Hendry said he understood. The young man waived an attorney today, but Carlton said that anytime he wants one, he should advise the court.“What he really wishes to do is enter a plea of guilty and waive a jury trial,’’ Sheriff Hendry, standing at his son’s side during the proceedings told the judge.Carlton determined the plea was freely and voluntarily given and accepted it. He ordered the pre-sentence investigation to learn of the young man's background prior to sentencing. The backgroundinvestigation is required by state Supreme Court rules.HENDRY SAID he was pleading guilty because the charge is true. Although he said he never went inside the restaurant, he admitted that he knew in advance it was to be burglarized and admitted that he aided and abetted in the crime. Florida law holds aiders and abettors as guilty asthe perpetrators.Sheriff Hendry brought his son to the police station to be arrested after police advised him that he was a suspect.Young Hendry is one of three persons who have testified so far to the Collier County Grand Jury investigating his father.
