ANOTHER ATTEMPT BEING MADE TO RETURN SAMMONS TO ILLINOIS PENITENTIARYSpringfield, 111., Oct. 6.—lt;£)—•Another attempt to have James “Fur” Sammons returned to the Illinois state penitentiary was initiated to* day by Attorney General Oscar E. Carlstrom and State's Attorney John A. Swanson of Cook county, in asking the supreme court for permission to file a mandamus suit, to compel circuit Judge Edward D. i Shurtleff of McHenry county, to j expunge his order releasing Sammons,/•The petitioners claim Sammons should be In prison both on murder and robbery charges of which he was convicted in 1904 in Chicago, Sammons was sentenced to death for killing Patrick Barrett but the next day Gov, Richard Yates commuted his punishment to life imprisonment, in 1923 Gov, Len Small commuted the sentence to 50 years. Sammons was paroled the same year and given a final discharge in1926. in 1930, Judge John P, Mc-Goorty ordered him returned to prison and the following year the supreme court in a habeas corpuscase, remanded him to the custody of the warden,This year, however, Sammons brought habeas corpus action in Judge Shurtleffs court and was released, Although Sammonfc is wanted by Chicago officials, they were not present to pick hint up when the judge freed him and he now isat liberty*
