Preliminary-• hearing in-tlin L'irHfc'-' degree, burglary charges sworn to bj£s Thomas Prough -against Byron Hal-,1 ley was scheduled to come before Judge C, A.- Bailey at 2 o’clock this afternoon. At 2:45 the parties connected with the trial had not appeared, -but the trial will, be 'held as soon as they arrive, j Hailey, who was arrested Saturday night, plead not guilty when he appeared before Judge C. A. Bailey In piobate court Monday -morning. His bond was set at $1,000. ‘ Being up-able to furnish it, he was remanded to the custody of the sheriff.■ The arrest was made following aS that someone had entered the Thomas Prough residence at 448 -Main' Aye-nue south. When the police arrived' no oho -was in sight, blit a Search of a freight train pulling out of town resulted in the arrest of Hailey. Of-fleers...state that he vwas;wearing, the Same iidt that was' alleged to .have been stolen at the Prough home and that he had considerable other clothing with him. -
