i«»fedee;oiti-r-DrinfuledrasiedbisdlyenttheearantJury Acquits KirkhamBert Kii'khatn, formerly of North Judson, who last June 9truck Elmus Tunis over the head with a bar of iron, was acquitted of a charge of assault and battery with intent to kill, by the jury which heard the case in circuit court Tuesday at Winamac.The trial brought out a number of the nasty details in connection with the affair—the stories by Kirkham and his wife alleging Tunis’ intimacy .with her, how Tunis was called to the Kirkham home in Winamac to hear her confession,” and the conflicting evidence as to who started the trouble, Tunis claiming that Kirkham liit him without provocation, and Kirkham asserting that he thought Tunis was about to draw a knife.The jury took the case Tuesday evening, and returned the verdict of not guilty in about three hours and a half. The members of the jury were John Epler, Andrew Moyer, Clarence Budd, NelsonMattix, Ralph Maibauer, S. W; Keplar,' George Magee, Gas Podell, Henry Wasser, A. P. Vurpillate, John F. Kopka and John Huff.
