J. Schino, for Webster. Immediately arose and addressed the jury, outlining .the defense that would be put up.In the course of his remarks. Schino declared that Webster had foared for his life for a long tlfne prior to the *hootiftr and chat Baty had *madc threats agalm-t his life. Schino aiso atated that the defense would show that on the day of the shooting Webster was a sick man and was not a Me to engage in a physical combat-with Baty. He further declared that Webster believed Baty* to be armed and got a gun to.protect himself. In closing Schlnb declared that the defense would show that Baty had been warned just before he was shot not to approach too.close to Webster but that he did not heed the warning.Schino further added that Webster was obliged to put hlmpelf under the protection. of peace officers to save himself from bodily injury at tho hands of Baty.Six more witnesses were placed on the stand yesterday morning to prove that^at the time of the shooting Baty was unarmed. These witnesses were Johnny l-andcr, S. E. Arnold. Fred • Barrett. W. B. Scott and Beter Daggs.John H. Redman, a deputy constable In Mariposa county. Fred Margrave. formerlv-A-doputy.--sherift~in~ the same county, and James F. Choyca, a constable In Mariposa county, were placed on the stand yesterday morning by the defense and all stated that Baty bore a bad reputation while in that county.The case was continued at noo2i untilMonday morning.
