A month ago because of his cruelty [and refusal to help, Mrs. Brent took full charge of the restaurant and separated from him. Later, she tiled suit fur divorce. When' papers in the divorce suit were served on Brent be called on his wife and asked her to withdraw the suit. This she refused to do and Brent began to drink heavily. On one occasion in« order to get rid of him, she told hiim she would think about withdrawing the suit.Later, Brent returned to the restaurant and asked her: “flattie, have jou made your mind what you are going to do?” She replied: “Yes, I am going to leave you and it is no use to talk to me. So go about your business and leave me alone.”At this, Brent drew a 38-caliber g:un ana said: “I am going to kill you.” The woman grabbed at the'gun to turn it aside but was not quick enough. The bullet Btruck her iu the left side. She ran to the tront cf the restaurant crjiug: “I, am shot.” Mrs. Brent I j staggered out to the sidewalk. An . | officer across the street ran to her and she told him who^hadsshot her. The officer ran to the rear of the restaurant and found Brent trying to escape. He and the officer grappled and Brent turned the gun against the officer .and pulled the trigger but the gun miffedlire. He pulled again and the bulletwent through „the officer’s coat andwas deflected‘by a memorandum book* Brent-then tried to shoot tbimsellf in the head.The officer#threw him and disarmed him.Mrs. Brent was taken to the hospital where her wound was at first pronounced fatal. The bullet had passed• . * *through the Btomacb, the liver and the great intestine and lodged near the spine.Brent was living with his sister, Mrs. Mary Perry, after he and his wife separated. The day before the shoo ting, Mrs. Brent had sent their little daughter, eight years old, away for fear Brent would kidnap her. Horace Perry, a nineteen-year-old son of Brent’s siister, who had gone to.the restaurant to protect her saw the shooting but was unable to help Mrs. Brent.Some eighteen years ago Brent was a telegraph operator in Danville and was called oh to answer/a paternity charge.
