The case was called yesterday morning and before court adjourned at 5 o’clock all of the testimony of the plaintiff was in and the examination of witnesses for the defense had been commenced. The witness stand was occupied for the greater part of the sessions yesterday by John Geier and Charles Newqulst, the complaining witnesses, and Dr. Ren C. Brooke.The alleged crime is claimed to have been committed March 1, 1909, when 1 the defendant is said to have shot John E. Geier and Edward Chambers | with a 41 Colts revolver at the Greiser ranch in the Little Prickly Pear valley, about 25 miles from Helena, a bullet lodging in the thigh of Geier and another in the hand of Chambers. Charles Newquist was present but escaped uninjured. The trouble arose over a quantity of hay which the complaining witnesses w’ere about to haul away from the ranch.Wan Once Convicted.Tiie information charging Rehberg with assuult wus first filed by former County Attorney Arthur P. Hey wood. He was tried, found guilty and sentenced to serve five years In the state penitentiary at Deer Lodge. JudgeClements later granted the defendanta new' trial.The following compose the Jury. James A. Wldmer, C. H. Rudolph, W. B. Smith, Louis Brackman, M. V. Wilson, T. D. Sloan, Nick Maronick. William Ashworth, W. J. Roberts, J. O. Beck, William Thomas and Herman Klein.The defendant is represented by Odell McConnell, while County Attorney H. S. Hepner appears for the state.
