Anmo Scnuli of Mahler Heights, arrested last week after an information charging her with practicing medicine without a license had been hied in the county court, wasagain arrested yesterday by Deputy Sht riff Hanna Jokerst, who was armed with a warrant from Coi|ner J. Morgan Sims.Several hours after the arrest attorneys for Mrs. Scholl Instituted a habeas corpus proceeding in the circuit court in an effort to secure her freedom or release 0.1 bail.Under the law* there is no way except through a habeas corpus proceeding, through wnich a prisoner may be released after a coroner’s jury has recommended that they bo held to the grand JuryThe warrant from the coroner states that the coroner’s jury foundthat the death of WiHimann Detei-mann was caused by gastro-enteritis and ’that the said Wiliimann Deter-mann was neglected during his illness owing to the fact that he was treated by Mrs. Anna Scholl alias Phallipa Scholl who was ignorant of medicine and having no license to practice.“Now therefore you are hereby required to receive into your custodythe said Mrs. Anna Scholl alias Phal-lipa Scholl and her safely keep until the grand jury investigates cause.”The warrant was received yesterday from Coroner J. Morgan Sims by the sheriff’s office and a deputy was immediately dispatched to the Scholl home in Mahler Heights where the arrest was made.Although the habeas corpus proceeding was started last night no action was taken in time- to secure Mrs. Scholl’s release at tnat time and sue spent the night ir» jail and remained there all of today.The petition for a writ of habeascorpus is signed by Charles F. Scholl husband of the woman, who is himself charged with practicing medicine without a license In an informationfiled last week* in the county court.The petition sets forth that Mrs. Scholl is being h- Id by the sheriffwithout any authority of law. Then the petition refers to the fact that the arrest was made by virtue of the coroner’s warrant and nothing else. The petition does not attack the validity of the coroner’s warrant.No attorney’s name is anywhere found on the petition. It being personally signed in each instance necessary by C. F. Scholl as petitioner.
