It was at that time that he’ fired the shot, Elswick explained, having the idea that Pauley was after a gun. Elswick was on the opposite side, of. the car at the time the shot was fired.■ The ease: is expected to go to the Jury today after, the court in-atructs the Jury and final arguments are made by counsel for the state and 'the defendant.Disclaims Intent To Kill “I didn’t intend to kill anyone,” Elswick said, I got the shotgun simply because 1 feared for my life. •.According to testimony of witnesses., for .both-the state and defendant,. Eiswick went to the Stof-fel residence earlier in the evening, and after being told that.his wife was not there, had a cab driver take him to a liquor store, then to his home, where he procured the shotgun, and back to the Stoffel home, where his wife had been living.Elswick. said he went there simply to keep the appointment with his wife, previously agreed upon, and that he had the gun because he thought he might meet up with Pauley,Told to Mind Own Business’1 The defendaht accused Pauley of breaking up his home and of having bad illicit relations with Mrs. Ela-wick. He said his wife had left him May 10 and that’several days later a daughter told him she (Mrs.] Elswick) had gone off with Pauley ( that night.According to Elswick, when he first objected to Pauley going around with Mrs. Elswick,,Parley told him, to mind his own business, and that 'he (Pauley) would kill Elswick if. the latter attempted to break up the affair,Ernest Clendenin of Charleston, H. R Archer of Kanawha City and R. E. 'Rollins of Kanawha-Two-Mile. | all employed at'the Libbey-owens- { Ford Glass Co. plant, where Els-; wick worked, testified _ that Els- • wick’s, general reputation as_ a j peaceful and law-abiding citizen was good.Tried to Warn Pauley W. H. Collins of BFD 1, Charleston, a resident of the Little Sandy community, testified he saw Elswick in the 'afternoon of May 29, and that he “thought something was going, to happen, Collins also testified that he met. Pauley later on and tried to warn him-and keep him from going toward the Stoffel home.The state contends that Elswick is guilty of murder in the first degree. and that when he went back to the Stoffel residence with the shotgun, his intent was to shoot Mrs. Elswick and Pauley.juntil about May 10 when the Els-! wicks separated,I Earlier. Elswick's seven-year-old i daughter, Mary Ann, testified that Pauley had taken her and her mother into Charleston to see ,a doctor on May 29, and that they had just returned to her uncle’s house when “Daddy came up and- shot Mr. Pauley.”Mrs. (Hazel Cart and Mrs..
