33-year-old Kansas man sentenced to die for 3rd time in 10 yearsBy Jonathan McDonald Odessa AmericanFORT STOCKTON — Shouts of joy accompanied 112th District Judge Brock Jones’ order that Charles Edward Smith be sentenced to death for the 1988 killing of a Pecos County deputy sheriff.The 33-year*old Kansas man showed no reaction yesterday as he was sentenced to die for the third time in 10 years.But the family of slain officer Tim Hudson shouted with joy and clappedwhen the verdict was read.The eight women and four men on the jury deliberated for less than three hours before reaching the conclusion that Smith deserves to die for his crime. IBsOri White, the 112th district attorney, who personally prosecuted the case against Smith, showed jurors Hudson’s badge and called the killing “an assassination,” in his closing remarks. The Texas Court of Criminal Appeals, the highest criminal court in Texas, overturned Smith’s two previous death sentences. Defenseattorney Martin Underwood of Comstock said he is confident this sentence will be overturned as well.“We’re in the appellate mode once again, which is nothing new to us,” Underwood said after the trial. He said he expected to have another appeal on its way to the Court of Criminal Appeals within a “couple months.” Gwen Hudson-Simmons, the daughter of the slain deputy, said she hopes the next trip she takes related to this case is to watch Smith’s execution.Sm KANSAS on Pago 4B
