Coroner's Jury Recommends Joseph C. Warf Be Held For District Court TrialA coroner's juiy recommended that Joseph C. Warf, 33, hair stylist, be held for trial in district court after hearing testimony Monday night at an inquest into the shotgun slaying of ltayraon C. Toll, 38, at the War! residence Sunday afternoon.Earlier in the day, War! pleaded innocent to a charge of premeditated murder filed by County Attorney John C. Harrison before Justice of Peace James C. Clarke, Warf appeared in court bu‘ entered the plea through his attorney, John W. Mahan, Clarke ordered Warf bound over to district court without bail. Warf be held for trial in district court/'The verdict was returned by Foreman Norman Matthews in behalf of jury members Barclay Craighead, Ike Lanning, Neil Martin, William Carbis, Ralph Andre, William J. Manning and A1 Larson.Three witnesses testified at the inquest called by Shcriff-Coroner Have Middleinas that Warf told Ihcm after the shooting that lie had killed a man. Mrs. Roger Landry, a neighbor at 623 Montana, said Warf told her that he had to kill the man because the man was going to cut his throat.C. 0. Glover. 623 Montana, and Mrs. Teddy Ball, 623 Montana, also testified that Warf had conic to their dwelling and told them he had killed a man.Testimony concerning drinking by bolh Warf and Toll, who was found dead in the blood-smeared front room at the Warf residence, was given by Elmer Edden, at whose home the two stayed the previous night, and Mrs. Toll.The jurors heard testimony that the two were drinking Saturday night, resumed drinking Sunday morning and left the Edden home near Lakeside to secure more liquor.Edden told the jury he refused to go hunting with the men because they were drinking. Originally they came to the Edden home to plan a hunting trip. He said the two were arguing aboutthe north and south but on friendjJy terms.Mrs. Warf testified that she had shown Warf’s hunting guns to the two men after they arrived at the Warf house from Edden’s shortly after noon Sunday. She sajd she did not at that time sec the hunting knife found in the room by the sheriff. She did identify the knife as belonging to Warf.Mrs. Warf said she went to the Warf residence Sunday morning in response to a call from her husband. She had been slaying with her parents, Mr. and Mrs, Waller Allen, 707 North Rodney. She was not questioned concerning drinking.Dr. O. J. Anderson, pathologist, testified concerning the nature of the wound that resulted in Toll’s death.Middlemas conducted the inquest.
