granamotner s nouse.When defense attorney Art McQuillan began his cross-examination, the girl said she had been threatened by Whitehead.McQuillan said the prosecution originally charged “rape with penetration” but amended the charge after the testimony from the girl.“I think the credibility of the alleged victim is in serious question in this case,” McQuillan said. “I think the commonwealth had to retreat from the original allegation due to the testimony on the witness stand.”Swope said amending the three charges puts her in a better position for prosecution. She said testimony from the girl that she said “ouch” was enough.“We just need to show his attempt,” Swope said.Whitehead is charged with attempted rape, attempted statutory sexual assault, attempted aggravated indecent assault, involuntary deviate sexual intercourse, indecent assault and child endangerment. The next available trial date is March 1. Nileski reduced bail to $5,000.
