iVANT CASE IN STATE COURTSX)UXSFL FOR MURDER OF JOE NARCELLE CLAIMS CRIME WAS COMMITTED OX STATELAND,Aberdeen, S. D.—“Iris'- Tommy” London was arraigned in federal‘ourt yesterday on an indictment'barging him with the murder ofloe Narcelle and entered a plea oflot guilty. Charles B. McCoy of Dupree, attorney for Condon, filed i demurrer to the indictment, claim-ng that the killing of Narcelle occurred on the portion of the Cheyenne River reservation which was opened to settlement in 1908, and that the alleged crime was under the jurisdiction of the state courts and aot of the federal court. The demurer will be argued later. Three mere indictments were returned by the federal grand jury. On chargesFrank Brown, a squawman, hue-hand of War Head Dress, upon whore allotment the shooting of Joe Narcelle by Tommy Condon took place with having introduced liquor on the reservation. Samuel Pate indicted, charged with a similar offense, and Brown Takes The Gun, an Indian, was charged with stealing a red steer to the value of $30. Brown Takes The Gun was not present when his name was called, and his bond of $500 was declared forfeited. James Dog Eagle was found guiltyof introducing liquor on the reservation, after the jury had been outseven hours, and was recommendedfor the minumum sentence for hisoffense,Oliver Campbell and George Quinn were indicted for introducing liquor on the allotment of Wi-tl-ca-Wln, onthe Sissetoii-Wq(hpeton reservation
