Never Been TriedAfter the 1936 robbery Chapman ^ and another man were indicted in r federal court for the robbery of the Atlanta bank in 103-1. They have never been tried, since Chapman escaped from state prison and is now at large. After the second robbery Chapman and his companion were positively identified by the fifth eye witness as being the men who robbed the bank in 1934. There are circumstances in tire record tending to corroborate him. There is some evidence in the record to the effect the three eye witnesses who later positively identified Southerland and Mathis first identified pictures of Charles Chapman as one of the robbers. This they deny, and It is fairly deducible from the evidence before me that they may have merely indicated the picture of Charlie Chapman re-scmbled one of the men who actu-ally rcbbed Lbe bank.
