Because of a miscalculation, a Waterloo man who pleaded guilty to two federal drug charges has been allowed to change his plea to innocent and will go on trial here today.Anthony P, Bruno, 28, is charged with distribution of 112.99 grams of methamphetamine on Aug. 10, 1988, and conspiracy to distribute methamphetamine between 1985 and 1988.Last month, Bruno entered a guilty plea in court where it was determined by Judge David Hansen that Bruno’s base offense level would begin at a level 34, Bnmo’s plea agreement with the government stipulated the government would make a motion for a two-level reduction for acceptance of responsibility, bringing the base level to 32.A base offense level of 34 translates into a sentencing range of 262-32? months in prison; level 32carries a sentencing range of 210-262 months.Within a week of the plea proceeding, the court determined Bruno would not be eligible for the two-level reduction because he is classified as a career offender, according to court documents.Bruno is a felon with two prior drug convictions in Black Hawk County: delivery of cocaine in 1986 and delivery of methamphetamine in 1987.After Bruno’s attorney was notified the two-level reduction would not be available to Bruno, he filed a motion to withdraw the guilty plea or to let the guilty plea stand with the two-level reduction.In granting Bruno’s motion to withdraw his plea, Hansen wrote he is prohibited by law to grant the reduction.Bruno was arrested in July with several other Waterloo residents as a result of a federal drug sweep. If convicted, he faces a maximum of 30 years in prison and a $4 million fine.
