She’s a liar, j jMarc McCrorywedding there wasn’t supposed toBy Sid SchwartzGazette StaffThe Janesville woman who prosecutors say was sexually assaulted by her husband made false claimsof sexual harassment in the past, the husband’s lawyer said Monday.Donald Lukas, 67, of 1400Joliet, has pleaded innocent to charges that he sex-u a 1 1 y assaulted his new bride in the weeks after their Jan. 10 marriage. Five weeks after the wedding, Lukas filed for divorce against the 34-year-old woman.Charges of felony third-degree sexual assault and misdemeanor fourth-degree sexual assault were filed after the woman told police Lukas forced himself on her even though they agreed before thebe any sex in their marriage.In court Monday, defense lawyer Marc McCrory said Lukas’ wife filed four sexual harassment claims while working as a pharmacy aide eight years ago in Fort Wayne, Ind. The allegations were of “inappropriate physical contact or inappropriate behavior which she construed to be of a sexual nature,” according to McCrory’swritten argument.All four claims were dismissed, McCrory said.“This woman has made false accusations in the past to get what she wants,” McCrory told the judge. “She’s a liar.”Normally, Wisconsin’s so-calledrape shield law prevents defense attorneys from using information about an alleged victim’s sexual past.The law provides an exemption, however, for evidence of prior false allegations of sexual assault.Jefferson County District Attorney David Wambach, who is acting as special prosecutor, said it’s not clear the woman’s Indiana allegations were false.Rock County Judge James Daley deferred a ruling on the admissibility of the Indiana allegations until seeing the evidence. He granted McCrory’s request to order depositions of the Indiana people familiar with the 1989 allega tions.Lukas
