I he prosecution failed to appear, and the cvideneojwas of such a doubtful characters that it was uncertain as to whether a case could have been made against them or not.Dave Mathers, accused of being accessory to the train robbery of Oct. 14th was arraigned, plead not guilty. The prosecution having failed to appear, the prisoner was released and his bonds cancelled. Tfiis seems to have been a case of malice as the prosecutor had no evidence whatever to sustain j his charge. These two cases were held under a warrant sworn out by one Texas Frank or Frank P. Whitfield.The case of Tkonius Geary aud Patrick II. Flemming, accused of complicity in the train robbery of Oct. 14th was continued until to-day at 10 o’clock, by request of the piosccution. They wishing to look into the matters la lit*lo farther before the case was brought to trial.
