I-Ie testified that he and Shadle had made plans to go groundhog: hunting early on the morning of July 2, They picked up rifles and started out on the trip, stopping first at the BufTalo Inn on Route 220 where they had several glasses of draught beer.Stopped In Jersey ShoreFrom the Buffalo Inn, the men progressed to a tavern In Jersey Shore, the name of which Butler couldn't remember, where they had several more drinks of beer and whiskey. They drove to Rauch town where they had originally planned to hunt and thero decided to go to the home of Roland Butler, about 2 miles east I of Loganton,At Roland Butler's home they met Butler and his uncle, William Jennings Butler, and after a .short talk decided to visit the Evening Star Tavern, a short distance from Loganton.There Butler said he was unable to recall all of what had happened, telling Judge Lipea and the Jury that he was pretty looped up” from the morning drinking.Guns Left In CarHe said, he recalled “Uncle Billy got pretty drunk” and that he took him out and put him in the back seat of Shadle's car, which was used for the trip. There he said he noticed the two guns which were to be used for hunting, on the floor behind the front seat.Charles Butler said he returned to the bar and saw a rumpus” underway between his brother and Shadle and Joined It. He said he couldn’t recall who started it—or what It was about. Walter U. Heckle, operator of the tavern, broke up the fight, Butler said.He testified he was unable to recall Shadle or his brother leaving the tavern. He said he walked out because he thought It was time to go home and saw his brother laying there alongside of the car.” He said he did nob recall hearing any shots fired.I gathered him up.” Butler continued, and tried to get him on the lawn . . .” He said he noticed blood on his brother’s neck. “I kind of blacked out a little,” he said. He added he did not remember his brother making any statements aboutu/hn shol; him.
