The til'st case was that of the state against Hiram Prouty. charged with the murder of August Luckins on June l.’i, 1S5M. The case has heen on the calendar three terms. Luckins. the man murdered, was an inmate of the county insane asylum, hut escaped from that institution, and was wandering about, supposedly trying to get over to Sauk, his former home. It is said he was seen in the vicinity of Plenty'sfarm in Bear Creek. Prouty ordered him to keep away, which It appears he did not do. Later he was walking along the road in front of Prouty’splace, and the latter stepped out and tired at Luckins, the bullet lodging in his abdomen and killing him almost instantly. Prouty was placed under arrest. The jury list was exausted in the afternoon, ami a special venire issued for 2o Jurors. The court took a recess until 2 o'clock to-day, when the trial was continued. Prouty has entered a special plea of Insanity.
