Rape suspects still out of schoolBy T.P. MULROONEY Staff Writer Two Chesapeake High seniors accusedof raping a 16-year-old girl are out of school despite a judge s ruling that they remain in school, a school official said yesterday.District Court Judge Robert N Lucke ordered May 8 that Howard Kelly, 18, of Pasadena and Ronald T Holden, 18, of Severna Park, return to school after he released them on $50,000 bond each Lucke ordered the boys to live with their parents and remain in school as part of the conditions of their release Chesapeake Principal William Norman ordered the boys to return home after theyhad unexpectedly shown up for school Tuesday, May 9, the day after the trial.Norman subsequently ordered the two men to stay at home despite Lucke’s ruling. Norman cited a school law that allows a principal to suspend a student who has been accused of a serious crime outside of the school. The principal can apply the law if he feels the students are dangerous to themselves or others or would disrupt the educational atmosphere at the school.After hearing of the school system’s decision to ignore his ruling, Judge Lucke said school officials would have to go to court to change the pre-trial conditions of release. Deputy Superintendent of SchoolsC. Berry Carter II, said yesterday that he and school system attorney Thomas J Wohlgemuth have reached a mutual agreement with Lucke to keep the boys out of school.Carter said the men will have lessons sent home to them. He said that the boys will be awarded a diploma if they successfully complete their courses, but they will not be permitted to participate in formal graduation ceremonies.Lucke said he originally ordered the men to return to school because they would be more restricted there than if they were allowed to roam 'the streets.Their preliminary hearing will be held tomorrow.
