Constable I*awrenre Chamberlain served the warrant on Roth In the Diamond early Wednesday morning, but Roth told Chamberlain to return the warrant to Calvin ami advise him that the St. Clair township justice had “no Jurisdiction within the cityof East Liverpool.Realty’s arrest at 10:4?* o'clock Tuesday night followed, it |s said, a visit at tie* police booth in the Diamond earlier In the evening. Roth claims that Realty entered the police booth and called him a vile name. He ordered Reatty from the booth, he asserts, ami Reatty crossed the street to a store. Reatty claims that he was crossing the Diamond to the store when Roth threatened to arrest him.A few minutes later Roth said he crossed to the store and as he opened the door Reatty called him another name. He said he told Reatty that he was under arrest and that the prisoner defied him The officer said that he tripped Realty throwing him to the floor. Reatty. according to Roth,while on the floor kicked and shouted. Roth then says lie (Rotlu “tapped Reatty on the head with his mace. The patrolman then handcuffed Reatty, claiming the prisoner refused to stand up Reatty was dragged through the door to tin* sidewalk, where he arose. The patrol was called for the trip to the city Jail.Reatty's story ot' the trouble differs from that of the policeman. He claims that he was taking a drink at the joda fountain counter in the store with bis back partly toward the door when be was struck from behind. He says that lie remembers nothing further until he was being searched at the city ball.
